Introduction
These Terms and Conditions (“Terms”) govern your use of Sophus3’s Rich Communication Services (“RCS”). By using this service, you agree to be bound by these Terms. If you do not agree, discontinue use of the RCS service immediately.
The customer also understands that access to and use of the RCS Messaging Services depends on accepting and following all the terms and policies mentioned below, as well as any related terms they reference. These terms and policies may be updated or changed at any time by Google LLC and its affiliates, including Jibe Mobile Inc. (together referred to as “Google”). It’s the customer’s responsibility to review them regularly to stay informed and ensure continued compliance.
Service Description
Sophus3’s RCS enables the exchange of messages, images, videos, and files via Wi-Fi or mobile data, offering advanced features beyond traditional SMS/MMS.
Eligibility and Activation
RCS is available to users with compatible devices and a valid Sophus3 account. On eligible devices, it may be enabled by default and can replace SMS/MMS when both sender and recipient have RCS activated.
Acceptable Use
You must use RCS in compliance with applicable laws, regulations, and these Terms. You are solely responsible for the content you send and must not engage in unlawful, harmful, deceptive, or unethical conduct or make false representations about Sophus3 or its services.
Service Modifications
Sophus3 may change, suspend, or discontinue RCS or these Terms at any time due to technical, legal, or business reasons. Material changes or service discontinuation will be communicated when feasible, and equivalent alternatives may be offered where possible.
Third-Party Providers
RCS may involve third-party technology providers. Use of the service is also subject to the terms and policies of these providers, which may be updated periodically. Users are responsible for reviewing and complying with such third-party terms.
Role of Google
Google, via its Jibe Cloud platform, powers the global RCS infrastructure. If your mobile carrier does not support RCS, Google may deliver it directly using its servers, allowing RCS to function over Wi-Fi or mobile data.
Google’s Messages app is the primary RCS client on most Android devices, enabling enhanced features when both users have RCS enabled.
Use of RCS is subject to Google’s terms and policies, including:
Your mobile network operator’s relevant policies
Google may change these terms at any time. It is your responsibility to stay updated and in compliance. Google applies end-to-end encryption where supported and handles RCS data per its privacy policies. Users should review Google’s Privacy Policy for more information on data handling, retention, and rights.
Suspension and Termination
Sophus3 may suspend or terminate your access to RCS if:
You violate these Terms or applicable policies
Required by law or legal process
Your conduct causes harm or liability to Sophus3, its users, or third parties
Where possible, Sophus3 will give advance notice, unless doing so would cause harm, breach the law, or affect service integrity.
Disclaimers and Liability
RCS is provided “as is” and “as available.” Sophus3 makes no guarantees regarding the service’s availability, reliability, or fitness for your needs, except where required by law.
To the fullest extent permitted, Sophus3 disclaims liability for damages resulting from your use or inability to use RCS.
User Content and Privacy
You retain ownership of the content you send but grant Sophus3 and its partners a license to process and transmit it as needed to provide the service. Use of RCS is also subject to Sophus3’s Privacy Policy, which governs data collection, use, and protection.
General Provisions
These Terms apply exclusively to your use of Sophus3’s RCS service and override other Sophus3 agreements where there is a conflict relating to RCS. If any part of these Terms is found invalid, the rest remains enforceable.
